I can't imagine that not refunding a player their $150k (not a small amount to many players) would be fair in the game rules.
By all rights you can refuse to serve them, but not keep their money. What gives you the right to punish other players? I find this very distasteful.

Perhaps distasteful to some, but this rule was clearly stated in the artist's rules from the very beginning. It would be a stickier situation had the artist added it to their rules after the sale had already commenced.

Artists are allowed to outline their own rules for their art they are selling, being as they are the creators/distributors of their art services. Since art is a non-game entity that is being exchanged between buyer and seller, it is out of EV hands, as per the T and C.

If players don't approve of an artist's rules, they have every right to steer clear of the sale, also :)

Frosted I would argue that it's a case of bullying and does come under the TOS - as I don't see a purpose for a set of rules such as these if not to lord it over other players. It takes 2 seconds to refund a payment and the point (to follow the rules) would have been made through simply refusing to sell.

But I will respect your judgement then and steer very clear from this artist :)

I certainly appreciate where you're coming from, SolE, but unfortunately when a member buys artwork from another member, they are agreeing to the artist's set rules, and whether the purchaser reads the rules or not, that responsibility falls upon the purchaser alone, and not on the person selling the art (provided the seller has already clearly outlined their conditions/rules prior to the exchange of EVD/EVC for art).
If you, or anyone else, would like to discuss this further, you're more than welcome to message me, or another mod, so we avoid cluttering this sales thread :).

I just wanted to publicly post this explanation so other people can see this, also, should they be unsure on how to perceive artists' rules in the future.

Ok, let's get this straight: I am NOT the first person to place this as a rule and statement that if rules ARE NOT followed, money will not be refunded. Distasteful as Frosted said, but necessary. It's almost become a point that rules are just there to "look pretty" it seems, and many don't read them through. In hopes of encouraging people to ACTUALLY read the rules, I'm hoping the no refund will help with that. Makes more sense to read a simple set of rules than to lose your money.

I adopted this rule simply because I am so sick and tired of people NOT following the rules, as done previously. Often times (as even seen in this post) I am lenient and allow some things to be edited. But it gets absolutely frustrating. And I assure you I'm not the only artist here that feels this way.

I can also assure you that I don't go in and change my rules and hold it against players for not noticing a change. Only changes to this sale have been to change the title.

SolE - I guess I'll say I'm sorry that I've lost you as a potential customer. However, I can assure you that everyone on this game that has known me knows I am as fair as it gets as well as honest as it gets. I'm not bullying anyone one bit. Just trying to have some way to encourage the players to read the rules.

I can understand the frustration for the artists - but I also see it from the buyer's side too in that it's a mad dash to get into the slots when they're -actually- slots and not auctions. Most of the time you barely have enough time to get your form filled out much less the rules read before it's totally full lol

Ruki, no I totally get that too. But usually if a slot fills with two posting at the same time, I usually will just take both slots.

I gotta say the no refunds for something as simple as missing a rule (which as Ruki said people are usually in such a frenzy to just get a tag that they sometimes overlook) seems a little extreme? I can understand your frustrations Cinch but shouldn't missing the sale be punishment enough? I don't think it's necessarily bullying per se but certainly a little harsh.

Being the creator of the bases I'd be happy to refund if Cinch isn't willing.
